Terms of Service

1. Who we are

MC Active (the “Service”) is operated by Anduin Enterprises LLC, a Georgia limited liability company (“we,” “us,” or “MC Active”). MC Active provides automated monitoring of public FMCSA records and reminders for document deadlines that subscribers upload to the Service. By accessing the website at getmcactive.com or creating an account, you agree to these Terms.

2. The Service is monitoring, not legal advice

MC Active is a compliance monitoring tool. We are not a law firm, a compliance consultancy, an insurance broker, or a representative of FMCSA. Nothing on the Service constitutes legal advice. We do not guarantee compliance with any federal, state, or local regulation. For legal advice, consult a licensed attorney.

3. System-of-Record, not System-of-Truth

MC Active reads and reflects public data from FMCSA's QCMobile API and other public sources, plus the information you provide. We are a System-of-Record monitor: the data we present is only as accurate, complete, and current as the upstream source and the information you have supplied. We are not a System-of-Truth. Always verify time-sensitive matters directly with FMCSA at safer.fmcsa.dot.gov or by contacting the agency directly before acting.

4. Your responsibility for data accuracy

When you upload documents (driver records, medical certificates, annual inspections, IFTA/IRP filings, BOC-3 designations, insurance certificates), the Service may extract data and ask you to confirm the extracted fields. By confirming, you warrant that the information is true, accurate, and current to the best of your knowledge. Alerts and reminders generated by the Service are based on the dates you confirm. Inaccurate input will produce inaccurate alerts.

5. Public FMCSA data

The Service surfaces information published by FMCSA through public endpoints. We do not guarantee FMCSA data accuracy, completeness, or availability. FMCSA may add, modify, or remove data at any time without notice. We are not affiliated with FMCSA, and the Service does not file documents, dispute records, or make submissions to FMCSA on your behalf.

6. Subscriptions, billing, cancellation

Paid tiers renew monthly or annually by default. Billing is handled by Stripe, Inc.; we do not store or process payment card data. You may cancel any active subscription at any time from your account dashboard or by emailing support@getmcactive.com. Cancellation takes effect at the end of the current billing period, and access to monitoring continues until then. Partial-month refunds are not provided unless required by law. Founding-rate pricing, where offered, remains locked at the founding price for as long as the subscription is continuously active; lapsing the subscription forfeits the founding rate.

7. Data retention and export

While your subscription is active, the Service retains the data you upload and the public records associated with your USDOT. Following cancellation, the Service retains your data for ninety (90) days, during which you may request an export by emailing privacy@getmcactive.com. After ninety (90) days, the Service deletes uploaded documents and confirmed records associated with the account, except where retention is required by law (for example, financial records and dispute logs).

8. Acceptable use

You agree not to:

• Use the Service to lookup or monitor a carrier you are not authorized to represent;
• Reverse engineer the Service, scrape it, or attempt to interfere with its operation;
• Use the Service to impersonate FMCSA, any government agency, or any other party;
• Resell, sublicense, or commercially redistribute the Service without our written permission.

9. Limitation of liability

To the maximum extent permitted by law, MC Active and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost revenue, lost data, business interruption, regulatory penalties, fines, insurance consequences, or operational losses arising out of or in connection with your use of the Service. Our aggregate liability for any claim related to the Service will not exceed the amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim.

10. Indemnification

You agree to defend and indemnify MC Active and its operators from any third-party claim arising out of: (a) your breach of these Terms; (b) information you submit to the Service that is inaccurate, outdated, or that you were not authorized to provide; or (c) your violation of any law or the rights of any third party.

11. Changes to the Service or these Terms

We may update the Service and these Terms from time to time. If we make a material change, we will notify active subscribers by email at least fourteen (14) days before the change takes effect. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in the Northern District of Georgia. The parties waive any objection to venue in such courts.
